Yorkville, Ill. –An agreement has been reached in the Kendall Marketplace lawsuit filed by nearby residents of the 800,000-square-foot mall. The mall, located on Route 34 and Cannonball Trail will house retailers such as Kohl’s, Target, and Home Depot along with other major tenants such as Linens ‘N Things, Office Max, PetSmart and Michael’s Arts and Crafts.

According to Lynn Dubajic, executive director for the Yorkville Economic Development Corporation, Kohl’s has stated that construction will begin in the very near future and is committed to a fall 2007 opening in the city.

As a part of the settlement reached today, the United City of Yorkville has agreed not to construct the proposed police station on the northeast corner of the property at Cannonball Trail. The developer of the project, Chicago-based Harlem-Irving Companies, will now need to provide the city with a new suitable site that has the same net buildable area no later than May 1, 2008 for the new police station. The new site would need City Council approval.

“I couldn’t be happier that we are moving forward with this worthwhile project for the residents of Yorkville,” said Mayor Art Prochaska. “Not only will we be able to provide convenient close to home shopping for our residents, we are also providing many of our residents and youth with new job opportunities. This will also help the city secure and attract new economic opportunities for the future as we continue to grow.”

Also as a part of the agreement, the cross-section on Blackberry Shore Lane will be reduced from four-lanes to three-lanes (standard residential with one turn lane).
